PREFACE Section 380.8 of the Code of Iowa requires at least once every five years, a city shall compile a code of ordinances containing all of the city ordinances in effect and any amendments made thereto since the previous recodification. In keeping with this statutory requirement, the mayor and members of the city council directed the city attorney, Bruce A. Green, to undertake the recodification of the municipal code for the City of Primghar, Iowa. The 1991 Code of Primghar, Iowa is not merely a codification of pre-existing ordinances. It is an entirely new code which supersedes all previous ordinances except those expressly saved by repeal by the adopting ordinance. It incorporates the latest recommendations of the Iowa League of Municipalities for the implementation of the Home Rule provisions of the Code of Iowa which are applicable for the statutory organization of this city. It also incorporates the most recent recommendations made by the city council to address present or foreseeable problems which have or may arise. The purpose of this code is two-fold. The citizens of the city have a right to know what local laws are in effect which pertain to their protection and govern their activities. Further, the members of the city council, mayor, and municipal employees must have adequate guidelines in furtherance of carrying out their duties and obligations as such. This code was designed to provide an accessible reference which would limit the need to refer to multiple resources by making express references to the applicable state law or the underlying state law from which the ordinance derives its authority. This code is organized by Title, Chapter, and Section. For example, Section 2.08.070 of the code refers to Title 2; the .08 refers to the Chapter; and, the .070 refers to the Section within that Chapter. This code was prepared and published by Bruce A. Green. The statutory research and drafting of new ordinances and revisions was conducted by James M. Carlin under the direct supervision of Bruce A. Green. The staff members involved in the preparation of this code gratefully acknowledge the assistance of the city clerk, Lee Fernstrum, the city council, and mayor of the City of Primghar without which this project could not have been undertaken.
