7.04.010 Definitions . For use in this chapter, the following terms are defined:

A. "At large" shall mean any licensed or unlicensed dog found off the premises of his owner and not under the control of a competent person, restrained within a motor vehicle, housed in a veterinary hospital or kennel, on a leash or "at heel" beside a competent person and obedient to that person's command.

B. "Dogs" shall mean both male and female animals of the canine species whether altered or not.

C. "Owner" shall mean any person or persons, firm, association or corporation owning, keeping, sheltering or harboring a dog.

7.04.020 At large prohibited . No owner of any dog shall permit such dog to run large whether the dog is licensed or unlicensed.

7.04.030 Impounding

A. Any dog found at large, whether the dog is licensed or unlicensed, in violation of Section 7.04.020 shall be seized and impounded or, at the discretion of the O'Brien County Sheriff, the owner may be served a summons to appear before the Iowa District Court (Magistrate Division).

B. Owners of licensed dogs shall be notified within two days that upon payment of impounding fees plus cost of food and care in a reasonable amount, the dog will be returned. If the impounded licensed dogs are not recovered by their owners within five days after notice, the dogs shall be disposed of in a humane manner as directed by the city council.

7.04.040 Violation-penalty . Any owner violating any of the provisions of this chapter shall, upon conviction, be subject to a fine not exceeding $10.00 for the first offense, $20.00 for the second offense, and $25.00 dollars for the third and every offense thereafter.

7.04.050 Actions of dogs constituting a nuisance

A. It shall be unlawful for an owner of a dog to allow or permit such dog to pass upon the premises of another thereby causing damage to, or interference with, the premises.

B. It shall be unlawful for an owner of a dog to allow or permit such dog to cause serious annoyance or disturbance to any person or persons by frequent and habitual howling, yelping, barking or otherwise; or by running after or chasing persons, bicycles, automobiles or other vehicles.

C. Violation of this section shall subject the owner to the imposition of penalties provided for in sections 7.04.030 and 7.04.040 of this chapter.

7.08.040 Violation-penalties

7.08.010 Purpose . In order to protect the health, safety and welfare of the residents and citizens of the City of Primghar, the city council enacts the following provisions.

7.08.020 Keeping prohibited . It shall be unlawful to keep, harbor, own, or in any way possess within the corporate limits of the City of Primghar, Iowa, any pit bull dogs or any other dog defined as vicious by Section 7.08.030 of this ordinance.

7.08.030 Definitions . For the purposes of this chapter, a vicious dog shall mean:

A. Any dog with a known propensity, tendency or disposition to attack unprovoked as evidenced by its habitual or repeated chasing, snapping, or barking at human beings or domestic animals so as to potentially cause injury or to otherwise endanger their safety; or

B. The bull terrier breed of dog; or

C. The Staffordshire bull terrier breed of dog; or

D. The American pit bull terrier breed of dog; or

E. The American Staffordshire bull terrier breed of dog;

F. Dogs of mixed breed or other breeds than above listed which breed or mixed breed is known as pit bulls, pit bull dogs or pit bull terriers.

7.08.040 Violation-penalties . Any person violating or permitting the violation of any provision of this ordinance shall, upon conviction, be fined a sum of not more than $100.00 or imprisonment in the county jail for a period not to exceed thirty (30) days.
