AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF PRIMGHAR, IOWA, 2004, BY AMENDING TITLE II, ARTICLE 2, SECTION 2.11(3) PAYMENT OF FEES FOR SOLID WASTE; AND BY AMENDING TITLE II, ARTICLE 9, SECTION 9.07(1) & (2) BILLING PERIODS FOR WATER SERVICE; AND BY AMENDING TITLE II, ARTICLE 10, SECTION 10.13(1) & (2) BILLING PERIODS FOR ELECTRICITY SERVICES; AND BY AMENDING APPENDIX A, SOLID WASTE, SUBSECTION A(1) & (2).
WHEREAS, the City of Primghar City Council has examined the Code of Ordinances pertaining to billing periods for both water and electricity service and for solid waste collection fees;
WHEREAS, the City Council feels it is in the best interest of the City to change the Code of Ordinances to reflect a more sound policy for billing and payment for water and electricity services;
WHEREAS, due to increasing costs of solid waste collection, the City Council finds it is in the best interest of the City to increase monthly solid waste collection fees for each residential premise from $10.00 to $12.00 and commercial garbage fees will be billed and collected by the solid waste contractor;
SECTION 1. SECTION AMENDED. The Code of Ordinances of the City of Primghar, Iowa 2004, Title II, Article 9, Section 9.07(1) and 9.07(2) Billing Periods for Water Service is amended and adopted to read as follows and will have an effective date of September 2005 billing cycle:
1. METERS READ. Water meters shall be read on or about the 3rd day of each month.
2. PAYMENT. All water charges are due on the tenth (10) day of each month following the close of the billing month payable by the twelfth (12th) day after the close of the billing month day to the city clerk.
SECTION 2. SECTION AMENDED. The Code of Ordinances of the City of Primghar, Iowa 2004, Title II, Article 10, Section 10.13(1) and 10.13(2) Billing Periods for Electricity Service is amended and adopted to read as follows and will have an effective date of September 2005 billing cycle:
1. METERS READ. Electrical meters shall be read on or about the 3rd day of each month.
2. PAYMENT. All electrical charges are due on the tenth (10) day of each month following the close of the billing month payable by the twelfth (12th) day after the close of the billing month day to the city clerk.
SECTION 3. SECTION AMENDED. The Code of Ordinances of the City of Primghar, Iowa 2004, Title II, Article 2, Section 2.11(3) Solid Waste Collection Fees is amended and adopted to read as follows and will have an effective date of September 2005 billing cycle:
3. PAYMENT OF FEES. The fees provided shall be due and payable at the office of the city clerk on or before the tenth (10) day of each month. The provisions of Subparagraphs 4 and 5 below shall be used to enforce collection of delinquent fees.
SECTION 4. SECTION AMENDED. The Code of Ordinances of the City of Primghar, Iowa 2004, APPENDIX A, SOLID WASTE, Section A(1) and A(2) is amended and adopted to read as follows:
A. The fee for solid waste collection and disposal service used or available shall be:
1. For each residential premise ---$12.00 (This fee will become effective with October 2005 billing cycle.)
2. Commercial garbage fees shall be billed and collected by the contractor and the contractor shall determine such fees.
SECTION 4. SEVERABILITY CLAUSE. If any section, provision, or any part of this ordinance shall be judged to be invalid or unconstitutional, such adjudication shall not affect the validity of this ordinance as a whole, or section, or provision or part thereof, not adjudged invalid or unconstitutional.
SECTION 5. WHEN EFFECTIVE. This ordinance shall be in full force and effect from after passage its final passage, approval and publication as provided by law.
