ORDINANCE NO. 2004-17
AN ORDINANCE AMENDING THE 2004 CODE OF ORDINANCES OF THE CITY OF PRIMGHAR, IOWA BY AMENDING SECTIONS OF APPENDIX A PERTAINING TO AMBULANCE RATES & FEES, AND SUBSECTION A. SEWER RATES; AND TO ADD A NEW SECTION 12.09 MAXIMUM NUMBER OF DOGS TO TITLE III, ARTICLE 12 REGULATION AND LICENSING OF DOGS
WHEREAS, the Primghar City Council feels it is in the best interest of the City to change the ambulance rates and fees to meet increased costs of ambulance operations; and
WHEREAS, the City of Primghar City Council has studied rates charged by the municipal utilities for sewer operations, maintenance and replacement fund for system improvements and needs additional revenue to meet increased costs of the sewer operations: and
WHEREAS, the City of Primghar City Council feels it is in the best interest of the City to limit the number of full grown dogs for safety health reasons and to protect the general welfare of the Community; and
BE IT ENACTED by the City Council of Primghar, Iowa;
SECTION 1. SECTION MODIFIED. The Code of Ordinances of the City of Primghar, Iowa 2004, is hereby amended by repealing Appendix A, Ambulance Rates & Fees, which establishes ambulance rates for all users and replaces this section with the following section adopted in lieu thereof:
Ambulance Rates & Fees
A. $225 BLS Non-Emergency
B. $375 BLS Emergency
C. $350 ALS 1 Non-Emergency
D. $425 ALS 1 Emergency
E. $600 ALS 2 Emergency
F. $400 Specialty Care Transport
G. $9.50/mile
SECTION 2: SECTION MODIFIED. The Code of Ordinances of the City of Primghar, Iowa 2004, is hereby amended by repealing the Consumption Rate of Operations, Maintenance and Replacement Fund in Appendix A, Sewer, Subsection A, which is a monthly rate per customer, and replacing the Consumption Rate of Operations, Maintenance and Replacement Fund with monthly rates as follows:
Sewer
A. Sewer services shall be furnished at the following rates per customer within the City Limits:
Consumption rate for operation, maintenance and replacement fund*
Residential $3.15/1,000 gallons of water usage
Commercial $3.15/1,000 gallons of water usage
* Rate(s) effective with January 2008 billing cycle.
Consumption rate for operation, maintenance and replacement fund**
Residential $3.65/1,000 gallons of water usage
Commercial $3.65/1,000 gallons of water usage
**Rate(s) effective with January 2009 billing cycle.
SECTION 3: SECTION ADDED. The Code of Ordinances of the City of Primghar, Iowa 2004, is hereby amended by adding a new Section 12.09 to Title III, Chapter 3, Article 12, which is hereby adopted to read as follows:
12.09 MAXIMUM NUMBER OF DOGS. A dog or canine is considered full-grown at the age of twelve (12) weeks of age. The numerical number of dogs kept on any residential premise shall be limited to two (2) full grown domesticated dogs. Once a dog reaches twelve (12) weeks of age, it is considered full grown and the dog counts toward the maximum number of dogs that can be kept on a residential premise.
SECTION 4. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION 5. SEVERABILITY CLAUSE. If any section, provision, or any part of this ordinance shall be judged to be invalid or unconstitutional, such adjudication shall not affect the validity of this ordinance as a whole, or section, or provision or part thereof, not adjudged invalid or unconstitutional.
SECTION 6. WHEN EFFECTIVE. This ordinance shall be in full force and effect from after passage its final passage, approval and publication as provided by law.
